This agreement is made between a dog trainer representing Hands to Paws, LLC, and the client (both referred to separately as Party and together as Parties). On the basis of mutual understanding and due consideration, the Parties agree to the following:
General Provisions
The purpose of this agreement is provision of the services described herein pertaining to the client’s dog. The trainer undertakes to provide the services in diligent and professional manner, while the client agrees act in accordance with the instructions provided by the trainer and to pay the fee for services rendered by the trainer.
Services
The trainer undertakes to provide private lessons for dog and client in accordance to the program they have selected. The lessons will take place at the client’s home or other appropriate place pursuant to the prior agreement between the parties. The purpose of the training is to adjust the behavior of the dog and to teach the client how to train and work with their dog. The client agrees that no training is perfect and that effects of the training can be affected by various factors. The trainer will take all appropriate measures to achieve training and behavior goals but makes no guarantees as to the results. The client further agrees to take all necessary steps to aid the Trainer and to follow on any instruction or advice provided by the trainer, especially to work with their dog daily and to constantly reinforce the training. The client further acknowledges that their dog may be exposed to a variety of environmental conditions which include, but are not limited to, vehicular travel, interaction with people and other animals, exposure to adverse weather, and exposure to areas with crowds and all types of traffic.
The trainer will provide training equipment or advise the client on the equipment that is necessary for them to acquire. The client agrees to use the equipment in accordance with the instructions provided by the trainer.
The trainer may take photos and videos of the dog for use in any media and advertising. The trainer may use such photos and video on any platform including their website, YouTube, Facebook, Instagram and other social media platforms.
Service Fees
The client agrees to pay to the trainer the amount listed for the program and can be paid for in installments. First installment is due before the first lesson. the trainer may deny training if the service fee is not paid before the lesson. The client may cancel the program with at least 24 hour notice in which case the client does not owe the service fee for that particular lesson. If the client cancels within 24 hours of the lesson, but not immediately before the lesson, the client is obligated to pay ½ of the service fee. No refund will be provided after the lesson commences or is unable to commence because of the client regardless of the number of lessons provided.
Rates for classes range from $55/session up to $275/session depending on scheduled visits/package size, time within the lesson, and information provided during the class. Only once the package or class is built by your trainer will you have an idea on what your class fees will be.
A 5% fee applies to invoices paid through all virtual and non paper installments unless noted by the trainer.
Package Cancelation
If a payment plan is agreed upon then canceled, the client agrees to pay any additional fees that may apply. Packages of 4 or more that have a payment plan that is canceled before the third lesson will not receive the deposit back and will complete payments covering an additional 20% of the remaining package cost. Packages of 4 or more that have a payment plan that is canceled with 3 or less classes remaining will not receive the deposit back and will complete payments covering an additional 45% of the remaining Package cost.
If the plan was paid in full, refunds will be made according to this guide for packages of 4 or more:
Cancelation before lesson 3 will result in a return of 60%. Cancelation with 3 or less classes remaining will receive a return of 20%.
All packages canceled, will resort in the fees being calculated in the term of classes used: ie if the package was of 6 lessons and 3 were used, the fees collected will be as if the package was initially of 3 lessons and will have the cost mirroring those costs on what it would initially cost.
All packages have an expiration of the package size plus 3 weeks. With some exceptions if presented by the trainer.
Individual
Lessons must be canceled no sooner then 12 hours prior to the set appointment time in order to reschedule without a fee being enforced. lessons canceled within 12 hours will be fully charged the lesson cost. rescheduled lessons must be within 7 days of the original appointment time (unless the trainer is unavailable) in order for the lesson to not be credited off. 2 reschedules will resort in a loss of the class credit no matter the length of warning time and will require prepayment of any other lessons prior to booking.
Lesson by lesson booking is now allowed but requires for the lessons to all be pre-purchased either at the time of the previous lesson or no later then 3 days prior to the appointment time requested. please note, this method does not guarantee a specific time and day each week and may depend on availability unless booked week ahead.
All class packages and single lessons have an expiration, double the number of classes unless otherwise discussed with the trainer. (ie: 3 lessons will expire in 6 weeks, 7 lessons will expire in 14 weeks and so on.)
Liability
The trainer is not liable for any damage or injury caused by the dog, during or after the term of this agreement. The client agrees to pay for all resulting losses or damages, and to hold harmless and indemnify the trainer, their employees and affiliates, from any resulting claims, lawsuits, costs and expenses, including attorney fees. If during or after the term this agreement the dog is injured or harmed, the client assumes the risk and agrees that the trainer should not be held responsible for any resulting injuries, losses, damages, costs or expenses.
The trainer is not liable for any damage or injury caused by the equipment during or after the training. The client is responsible for destroying or damaging of the equipment provided by the trainer in all cases where such damage cannot be credited to equipment’s regular wear and tear.
Term of the Agreement
This agreement is valid until terminated. This agreement is automatically terminated when the lessons are completed. This agreement may be terminated in the sole discretion of the trainer if the dog is aggressive, dangerous, or otherwise deemed unsuitable for training, or if the client breaches any part of this agreement.
Final Provisions
In case of any dispute the parties agree to mediate and settle through negotiations and mutual understanding.
This contract for training services supersedes all other agreements, written or oral, previously made between the client and trainer.
How often should classes be scheduled? - i recommend no more then 14 days between lessons to aid in consistency and ensuring any and all questions are answered regularly.
How can this help my dog socialize? - i don't believe in putting dogs over threshold, so in focusing on communication and taking things slowly allows you and your pup to gain confidence within each other so crowds and groups become manageable. Socializing is being calm in environments and situations, not just constant exposure, especially if it will cause stress for both parties.
